Important Signer Requirements

The signer must:

• Personally appear before the notary
• Provide acceptable identification
• Be willing to sign
• Be alert and aware
• Understand that they are signing a document
• Communicate directly with the notary in English

Dementia, Cognitive Impairment, or Serious Illness

A diagnosis, age, illness, or residence in a care facility does not automatically determine whether a notarization can or cannot proceed.

However, the notary must be able to communicate directly with the signer and assess whether the signer appears willing, aware, and able to participate in the notarial act at the time of the appointment.

If the signer is confused, unwilling, unable to communicate, or appears pressured, the notarization may be refused.

Family and Facility Coordination

Family members, caregivers, or facility staff may help coordinate the appointment. However:

• The signer must communicate directly with the notary in English
• The signer must be signing voluntarily
• The signer must provide acceptable identification
• The notary cannot rely on someone else to answer for the signer
• The notary cannot provide legal advice

Before Scheduling

• The signer has acceptable ID
• The signer will be awake and available
• The signer understands that a document needs notarization
• The signer is not taking medication, or under the effect of any medication, that could impair their ability to understand the notary process or the document they are signing
• The document is complete
• If witnesses are required, the signer, family, or care facility has arranged for them to be present
• The facility allows the appointment
• Parking or access instructions are available
